A federal appeals panel in San Francisco refused to block the scheduled Friday imprisonment of U.S. District Judge Harry Claiborne, sentenced to two years after conviction for filing false tax returns. Lawyers for Claiborne had filed an emergency appeal, claiming a federal judge cannot be imprisoned prior to impeachment. The U.S. 9th Circuit Court of Appeals turned the Las Vegas judge down after hearing arguments in a conference telephone call. His attorneys were expected to take their plea to the U.S. Supreme Court. Claiborne, 68, has been sentenced to a minimum-security prison at Maxwell Air Force Base, Ala.
