Denver’s Clarence Kay, a two-time loser under the NFL’s substance-abuse policy, apparently will avert a lifetime suspension after his latest alcohol-related arrest. Kay’s blood-alcohol level tested at .093%, just below the legal intoxication limit of .10.
Kay, the Broncos’ tight end, faced a similar predicament last summer but was spared by Commissioner Paul Tagliabue because his blood-alcohol content registered .083%, below the limit.
